Uppdatering – Nya regler om permanent uppehållstillstånd i Sverige

NYHETSBREV: UPPDATERING OM REGLER FÖR PERMANENT UPPEHÅLLSTILLSTÅND (JULI 2026)

(Lagändringarna trädde officiellt i kraft den 12 juli 2026, som en del av reformen av migrationssystemet. Målet är strängare invandringskontroll och anpassning till EU:s nya migrations- och asylpakt.)


1. Permanent uppehållskort (PUT) avskaffas helt för varaktigt bosatta

Enligt det senaste beskedet från Migrationsverket kommer lagändringarna att i grunden förändra utländska medborgares uppehållsrätt. Migrationsverket slutar utfärda det permanenta uppehållskortet till personer som har fått status som varaktigt bosatt (long-term resident status).

  • Systemet före den 12 juli 2026: Den som fick status som varaktigt bosatt fick både ett EC/EU-kort och ett permanent uppehållskort samtidigt.

  • Systemet från den 12 juli 2026: Den som får denna status får istället ett EC/EU-kort tillsammans med ett uppehållskort som gäller i högst 5 år.

  • Övergångsregel: Har du redan ett permanent uppehållskort utfärdat före detta datum behåller du alla dina nuvarande rättigheter, helt opåverkat.


2. Permanent uppehållstillstånd slutar utfärdas för skyddsbehövande (asyl)

I linje med samma politik slutar Sverige även att utfärda permanenta uppehållskort till personer med uppehållstillstånd kopplat till asyl och internationellt skydd.

  • Ny handläggningsprocess: För den som redan har ett tidsbegränsat uppehållstillstånd och ansöker om permanent uppehållstillstånd kommer Migrationsverket inte längre att utfärda PUT-kort. Istället flyttas alla obehandlade ansökningar (oavsett när de lämnades in) automatiskt över till en ny bedömning: om personen istället uppfyller kraven för att få sitt tidsbegränsade uppehållstillstånd förlängt.


3. Nya regler för att ansöka om svenskt medborgarskap

En viktig del av riksdagens reformpaket är en flexibel justering av medborgarskapslagen, för att den ska stämma överens med att PUT-kortet avskaffas.

  • Undantag från PUT-kravet: Normalt är ett permanent uppehållskort ett grundkrav för att bli svensk medborgare. Men från och med den 12 juli 2026 gäller undantag för personer med status som varaktigt bosatt, eller personer med asylstatus/subsidiärt skydd.

  • Alternativt krav: För att kunna söka medborgarskap måste denna grupp istället visa antingen en "välgrundad utsikt" (well-founded prospects) att kunna behålla ett stabilt, långvarigt uppehälle i Sverige, ELLER bevisa att de bott oavbrutet i Sverige i minst 10 år.


4. Ny gränsscreening och kraftigt minskad rätt till offentligt biträde

För att uppfylla EU-paktens minimikrav inför Sverige striktare kontroller redan från mottagningsfasen:

  • Ny screeningprocess: Svenska polisen kommer att samarbeta med Migrationsverket för att göra en helhetskontroll av identitet, säkerhet och hälsa, samt bedöma om personen tillhör en särskilt sårbar grupp. Detta sker på stora mottagningscenter som Boden, Märsta/Arlanda, Mölndal och Malmö.

  • Begränsad juridisk rådgivning: Rätten till gratis offentligt biträde (advokathjälp) för asylsökande begränsas kraftigt. Sökande får nu högst 2 timmars juridisk rådgivning i det första ansökningsskedet. Full rätt till juridiskt biträde återinförs endast om personen går vidare till att överklaga ett avslagsbeslut från Migrationsverket.

(These legislative changes officially took effect on 12 July 2026, as part of the broader reform of the migration system — aimed at tighter immigration control and alignment with the EU's new Migration and Asylum Pact.)


1. Permanent Residence Card (PUT) Fully Discontinued for Long-Term Residents

According to the latest notice from the Swedish Migration Agency (Migrationsverket), these legislative changes fundamentally alter foreign nationals' residence rights. The agency will stop issuing the permanent residence card to individuals granted long-term resident status.

  • System before 12 July 2026: Applicants approved for long-term resident status received both an EC/EU card and a permanent residence card simultaneously.

  • System from 12 July 2026 onward: Those approved for this status instead receive an EC/EU card together with a residence card valid for a maximum of 5 years.

  • Grandfathering provision: Anyone who already holds a permanent residence card issued before this date keeps all their current rights fully unaffected.


2. Permanent Residence Permits Discontinued for Asylum-Based Status

In line with the same policy, Sweden is also officially discontinuing the issuance of permanent residence cards to people whose residence permit is linked to asylum and international protection.

  • New processing procedure: For those who already hold a temporary residence permit and are applying for permanent residency, the Migration Agency will no longer issue PUT cards. Instead, all pending applications (regardless of when they were filed) are automatically shifted to a new type of assessment: whether the applicant instead qualifies to have their temporary residence permit extended.


3. New Rules for Applying for Swedish Citizenship

A key part of the Riksdag's reform package is a flexible adjustment to the Citizenship Act, to bring it in line with the discontinuation of the PUT card.

  • Exemption from the PUT requirement: Normally, a permanent residence card is a prerequisite for becoming a Swedish citizen. However, from 12 July 2026 onward, this mandatory requirement is waived for individuals with long-term resident status, or with asylum/subsidiary protection status.

  • Alternative requirement: To apply for citizenship, this group must instead demonstrate either "well-founded prospects" of maintaining stable, long-term residence in Sweden, OR prove they have lived continuously in Sweden for at least 10 years.


4. New Border Screening and Sharply Reduced Access to Public Legal Counsel

To meet the EU Pact's minimum standards, Sweden is introducing stricter controls starting from the reception stage itself:

  • New screening process: The Swedish Police will work together with the Migration Agency to conduct a comprehensive check of identity, security, and health, and to assess whether the person belongs to a particularly vulnerable group. This takes place at major reception centers such as Boden, Märsta/Arlanda, Mölndal, and Malmö.

  • Limited legal counsel: The right to free public legal counsel (Offentligt biträde) for asylum seekers is being significantly reduced. Applicants now receive a maximum of 2 hours of legal consultation during the initial application stage. Full legal representation is only reinstated if the applicant proceeds to appeal a rejection decision from the Migration Agency.
